Sir,
I am commanded by the Army Council to refer to their letter 124/Malaya/18(C.A.1.) dated 11 October, 1945, enclosing a draft interim directive, together with an explanatory memorandum, on matters relating to transactions in land and' property in Malaya during the Japanese occupation.
Further consideration has now been given to this question and subject to any comments that you may have, the whole Directive may now be regarded as approved, with the exception of Part IV (Mortgages and Charges) which is reserved for further consideration.
Of the three sub-paragraphs of Para. 2 of the Explanatory memorandum which were reserved for further consideration.
(d) is now approved subject to the removal of the
reference to mortgage interest pending a decision on Part IV of the Directive.
(f) is now approved.
(g) should be amended to read "to disallow claims
by absentee owners for rents and profits of their lands, accrued to trespassers or unauthorised occupiers during the Japanese Occupation", and, as so amended, is approved.
The Council would be glad to have your early comments.
